Terms & Conditions

Welcome to PropFair. These terms govern your access to and use of our platform, including competitions, entries (“tickets”), PropCredits (PFC), listings, live reveals, and related services. By using PropFair, you agree to these Terms.

1) Acceptance of Terms

By accessing or using PropFair (the “Service”), you agree to be bound by these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree, you must not use the Service.

2) Eligibility & Accounts

  • You must be at least 18 years old (or the legal age of majority in your jurisdiction) to use PropFair.
  • You agree to provide accurate registration information and keep it updated.
  • You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account.
  • We may suspend or terminate accounts for violations of these Terms, suspected abuse, or where required by applicable law.

3) Regions, Compliance & Responsible Use

PropFair is designed to operate across multiple regions. Some competitions, features, or listings may not be available in all jurisdictions, and local rules may apply.

  • You are solely responsible for ensuring that your participation in any competition or listing complies with the laws and regulations of your country or region.
  • We may geofence, restrict, or modify access to certain features where required by regulatory, risk, or platform policy reasons.
  • Where required, we may label competitions as region-restricted, global, or subject to additional local rules.

4) Entries (“Tickets”), PropCredits (PFC) & Competition Mechanics

  • Each entry represents a non-transferable right to participate in a specific competition for an advertised asset, bundle, experience, or benefit.
  • Participation is denominated in PropCredits (PFC), the platform’s internal credit unit. The PFC cost per entry and the total number of entries (or maximum pool) are shown on the relevant page.
  • In skill-based competitions, a qualifying question or task may be required. Only users who correctly answer or complete the requirement may be eligible to enter, as described on the competition page.
  • Closing times, pool progress, vault conditions, and any special eligibility constraints are displayed on the competition page. We may extend, reschedule, or modify a competition where operational, compliance, or safety reasons require it; any material changes will be communicated on that page.
  • Winners are selected using fairness-first, verifiable selection procedures. The method used (e.g. verifiable randomness, public proof, commit–reveal) will be specified in the competition documentation or proof page.
  • PropFair may void, cancel, or refund entries (in PFC or equivalent credits) affected by fraud, technical errors, policy breaches, or regulatory restrictions.

5) PFC Pricing, Fiat Payments & Fees

  • All participation on the platform is ultimately denominated in PropCredits (PFC). Competition entry amounts, rewards, and certain fees are expressed in PFC, even if you initially fund your account in a fiat currency.
  • Fiat top-ups, card payments, bank transfers, or alternative payment methods are processed by third-party payment providers, who may apply their own fees, FX rates, or limits. These providers may convert your local currency into PFC balance according to their rates at the time of transaction.
  • Where displayed, estimated fiat equivalents are for convenience only and do not change the underlying PFC amount.
  • Taxes, duties, and compliance-related costs (if applicable) are your responsibility unless explicitly stated otherwise.
  • We may adjust PFC pricing, introduce or modify platform fees, withvault promotions, or run temporary offers by updating the relevant pages. Any such changes will not retroactively affect completed transactions.

6) Cancellations, Refunds & Chargebacks

  • Once entries are confirmed and a competition is live, PFC spent is generally non-refundable. In the event a competition is canceled or materially altered (for example, if the advertised asset cannot be fulfilled), we may provide refunds or credits (in PFC) at our discretion.
  • Where third-party payment processors are involved, their refund and dispute policies may also apply.
  • Chargebacks initiated through your bank or payment provider without first contacting PropFair support may result in temporary holds, reduced limits, or account actions where fraudulent or abusive patterns are suspected. Please reach out to support first so we can review your case.

7) Verification (KYC), Inspection & Delivery

  • To protect users and comply with regulatory obligations, we may request identity verification (e.g., government ID), proof of address, liveness checks (selfie or video), and other KYC steps for winners, high-value participants, and vendors.
  • For physical or high-value assets, PropFair or its partners may inspect, document, or re-verify the item before delivery or transfer.
  • Winners must respond within the stated time window and cooperate with required checks, documentation, and logistics in order to claim their prize.
  • Failure to complete verification, respond in time, or comply with legal requirements may result in forfeiture of the prize, in which case PropFair may rerun, reallocate, or cancel the outcome as appropriate.

8) Vendors, Listings & Prohibited Items

Premium Vendors, Wholesale Vendors, Real Estate Vendors, and Businesses using PropFair must follow platform rules and all applicable laws.

  • You may only list assets you own or are fully authorized to represent.
  • You must not list counterfeit, illegal, unsafe, infringing, or otherwise restricted items. Regulatory and export/import rules remain your responsibility.
  • You agree to provide accurate descriptions, clear photos or videos, and to cooperate with verification, inspection, and buyer support.
  • PropFair may edit, hide, or remove listings that violate policy, create undue risk for users, or conflict with platform standards.

9) Content & Intellectual Property

  • “PropFair”, associated logos, design language, and platform UI are protected by intellectual property laws.
  • By uploading content (such as photos, videos, descriptions, or branding assets), you grant PropFair a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, and display that content in connection with operating and promoting the Service.
  • You must not upload content you do not have the rights to use or that infringes the rights of others.

10) Community Rules & Conduct

  • You must not engage in fraud, collusion, manipulation of competitions, or any attempt to artificially influence outcomes.
  • Harassment, hate speech, abusive behavior, or threats towards other users, vendors, or staff are not permitted.
  • You may not scrape, reverse engineer, or attempt to bypass security measures of the platform.
  • Respect privacy: do not publish or share others’ personal data without explicit consent.

11) Disclaimers & No Warranties

The Service is provided on an “as is” and “as available” basis. To the fullest extent permitted by applicable law, PropFair disclaims all warranties, express or implied, including, without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected. We make no guarantees regarding specific outcomes, winnings, or that any particular competition will run or complete without change.

12) Limitation of Liability

To the maximum extent permitted by law, PropFair and its affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of profits, revenue, data, goodwill, or other intangible losses arising out of or related to your use of (or inability to use) the Service.

In all cases and to the fullest extent permitted by law, PropFair’s aggregate liability for any claim relating to the Service will be limited to the greater of:

  • the total PFC-equivalent value of the fees you paid to PropFair for the Service in the three (3) months preceding the event giving rise to the claim; or
  • a fixed amount reasonably representing a minimal cap under applicable law (if required), as specified in the relevant jurisdictional terms if made available.

13) Governing Law & Disputes

These Terms, and any dispute or claim arising out of or in connection with them or their subject matter, will be governed by and construed in accordance with the laws of the jurisdiction in which the PropFair operating entity is organized, without regard to conflict of law principles.

Parties will first attempt to resolve disputes in good faith through informal discussions. If a resolution cannot be reached within a reasonable time, disputes may be submitted to arbitration or courts of competent jurisdiction, as specified in any supplemental regional terms or in the legal notices on the platform.

14) Suspension & Termination

We may suspend, limit, or terminate your access to the Service (in whole or in part) if we reasonably believe you have violated these Terms, engaged in fraud or abuse, created legal or regulatory risk, or where we are required to do so by law or a competent authority.

You may stop using the Service at any time. Some provisions of these Terms will continue to apply after termination, including those relating to intellectual property, disclaimers, limitation of liability, and dispute resolution.

15) Changes to These Terms

We may update these Terms from time to time. Material changes will be posted on this page with an updated “Last updated” date or otherwise communicated through the platform.

Your continued use of the Service after changes become effective constitutes your acceptance of the revised Terms. If you do not agree to the updated Terms, you should stop using the Service.
