Terms & Conditions

By accessing or using PropFair (the “Service”), you agree to be bound by these Terms & Conditions (“Terms”) and our Privacy Policy. If you do not agree, do not use the Service.

• You must be at least 18 years old (or legal age of majority in your jurisdiction).
• Provide accurate registration information and keep it updated.
• You are responsible for maintaining the confidentiality of your login credentials.
• We may suspend or terminate accounts for violation of these Terms or applicable law.

Availability of draws, listings, and features may vary by region. You are responsible for ensuring your use complies with local laws, including tax, import/export, and promotional regulations where you participate.

• Each entry is a non-transferable right to participate in a draw for a specified asset or bundle.
• Entries, odds, pool progress, and closing times are displayed on the product page. We may extend or reschedule a draw for operational or compliance reasons; any material changes will be communicated on the page.
• Winners are selected via verifiable, fairness-first procedures. Listing-specific mechanics and eligibility constraints will be shown on the page.
• PropFair may void or refund entries impacted by fraud, technical faults, or policy breaches.

• Prices are shown in NGN unless otherwise stated.
• Accepted payment methods are shown at checkout. Third-party processors may apply fees.
• Taxes, duties, and compliance costs (if any) are your responsibility unless explicitly included.
• We may change pricing, introduce new fees, or run promotions with notice on the relevant pages.

• Entry purchases are generally final. If a draw is canceled or materially altered, we may issue refunds or credits at our discretion.
• Chargebacks initiated without contacting support may result in account actions. Please reach out to support first.

• We may request identity (e.g., national ID), face scan/selfie video, proof of address, and other checks for winners, sellers, or higher-tier accounts.
• For physical assets, PropFair or partners may inspect/document items before delivery.
• Winners must respond within the stated time window to coordinate delivery, taxes/duties, and any required paperwork.

Premium Vendors, Wholesale Vendors, Real Estate Vendors, and Businesses must comply with listing rules and applicable laws.

• You must own or be authorized to list assets you submit.
• No counterfeit, illegal, unsafe, infringing, or restricted items.
• You agree to accurate descriptions, clear photos/videos, and to cooperate with verification/inspection.
• PropFair may remove listings that violate policy or present risk to users or the platform.

• PropFair trademarks, branding, and the platform UI are protected by law.
• By submitting content (e.g., photos, videos, descriptions), you grant PropFair a non-exclusive, royalty-free license to use, reproduce, and display it in connection with the Service.
• Do not upload content you don’t have the rights to use.

• No fraud, harassment, hate speech, or manipulation of draws/listings.
• No scraping, reverse engineering, or interfering with platform security.
• Respect privacy and do not share others’ personal data without consent.

The Service is provided “as is” and “as available.” To the fullest extent permitted by law, PropFair disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not guarantee uninterrupted or error-free operation.

To the maximum extent permitted by law, PropFair will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or goodwill, arising out of or related to your use of the Service. In all cases, PropFair’s aggregate liability will not exceed the greater of (a) NGN 50,000 or (b) the amounts you paid to PropFair in the 3 months preceding the claim.

These Terms are governed by the laws of the Federal Republic of Nigeria, without regard to conflict of law principles. Disputes will be attempted first through good-faith negotiation; if unresolved, parties agree to binding arbitration or courts of competent jurisdiction in Abuja, Nigeria.

We may suspend or terminate your access for violations, suspected fraud, legal requests, or platform risk. You may stop using the Service at any time. Certain provisions survive termination (e.g., IP, disclaimers, liability).

We may update these Terms. Material changes will be posted on this page with an updated “Last updated” date. Continued use constitutes acceptance of the revised Terms.
